Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of The Aspect ("the Service"), operated by The Create Corporation, doing business as "The Aspect" ("we," "us," or "our"). By creating an account, accessing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

We may update these Terms from time to time. When we make material changes, we will post the revised Terms on this page with an updated effective date. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the updated Terms.

2. Service Description

The Aspect is a premium astrology platform that provides natal chart analysis, real-time transit tracking, compatibility reports, personalized interpretations, moon phase calendars, retrograde tracking, audio content, and educational resources.

3. Account Registration

To access certain features of the Service, you must create an account by providing a valid email address and birth information. You are responsible for maintaining the accuracy of the information you provide, safeguarding the security of your account credentials, and all activity that occurs under your account.

You must be at least 16 years of age to register for an account. We reserve the right to suspend or terminate accounts that are found to be in violation of these Terms.

4. Subscriptions & Payments

The Service offers both free and premium subscription tiers. Premium subscriptions unlock additional features and content.

Billing

Payments are processed through third-party payment processors. Premium subscriptions are billed on a recurring basis, either monthly or annually, depending on the plan you select.

Price Changes

We will provide at least 30 days' notice before any changes to subscription pricing take effect.

Free Trials

If you sign up for a free trial, you may cancel at any time during the trial period. You will not be charged until the trial period ends.

Cancellation

You may cancel your subscription at any time through the Settings page. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that time.

Refunds

Refund requests are evaluated on a case-by-case basis for charges made within the prior 7 days. We do not provide partial-period refunds.

5. California Auto-Renewal Disclosures

As required by California Business and Professions Code § 17600 et seq., the following disclosures apply to your subscription:

• Your subscription will automatically renew at the then-current rate unless you cancel before the end of the current billing period.
• You will be charged on a recurring basis (monthly or annually) until you cancel.
• You may cancel at any time through the Settings page or by contacting us at support@theaspect.app.
• Cancellation takes effect at the end of the current billing period. You will not be charged again after cancellation.

6. Acceptable Use

When using the Service, you agree not to:

• Use the Service for any purpose that is illegal or prohibited by these Terms
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the Service
• Scrape, crawl, or use automated means to collect data from the Service without our prior written consent
• Interfere with or disrupt the integrity, security, or performance of the Service
• Create multiple accounts for the purpose of circumventing restrictions or abusing the Service
• Redistribute, republish, or commercially exploit any content from the Service without authorization

7. Intellectual Property

All content, design, code, algorithms, and branding associated with the Service are the intellectual property of The Create Corporation and are protected by applicable copyright, trademark, and other intellectual property laws.

You retain full ownership of your birth data and any personal content you provide to the Service. By using the Service, you grant us a limited, non-exclusive license to use such data solely for the purpose of operating and improving the Service.

8. Automated Content

The Service uses automated computational systems, including algorithmic analysis and other computational methods, to generate personalized astrological content based on your birth data and current celestial positions.

• Automated content may contain inaccuracies or produce different results between sessions.
• We continuously improve our systems but do not guarantee the accuracy, completeness, or reliability of any generated content.
• You may not represent content generated by the Service as professional astrological counsel.
• Personal readings are intended for your personal use only.

9. User-Generated Content

You retain ownership of all content you create through the Service, including journal entries, chart notes, and shared links. By using the Service, you grant us a limited, non-exclusive license to use, display, and process your content as necessary to provide the Service's functionality.

We reserve the right to remove any user-generated content that violates these Terms or is otherwise objectionable, at our sole discretion.

10. Privacy

Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

11. Limitation of Liability

To the maximum extent permitted by applicable law, The Create Corporation and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use the Service.

In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service exceed the total amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in this section is intended to limit liability that cannot be limited under applicable law, including California consumer protection statutes.

12. Disclaimer of Warranties

The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected.

13. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless The Create Corporation and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the County of Los Angeles, California.

Arbitration

You and The Create Corporation agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its then-current rules, except as provided below.

Small Claims Court

Either party may bring an individual claim in small claims court in the County of Los Angeles, California, if the claim qualifies for small claims court jurisdiction.

Arbitration Opt-Out

You may opt out of the arbitration provision within 30 days of first using the Service by sending a written notice to support@theaspect.app. Your notice must include your full name, account email address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved exclusively in the courts described above.

Class Action Waiver

To the extent permitted by law, all disputes shall be resolved on an individual basis. You agree that you will not bring, join, or participate in any class action, collective action, or representative action regarding any claim arising from these Terms or the Service.

Nothing in this section is intended to waive or limit your consumer protection rights under California law or the California Consumer Privacy Act (CCPA).

15. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms. You may delete your account at any time through the Settings page.

Upon termination, you have the right to request an export of your data by contacting us at support@theaspect.app.

The following provisions shall survive termination of these Terms: Limitation of Liability, Disclaimer of Warranties, Indemnification, and Governing Law & Disputes.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and The Create Corporation regarding your use of the Service, and supersede all prior or contemporaneous agreements, understandings, or representations, whether written or oral.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will post the revised Terms on this page with an updated effective date. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you should discontinue your use of the Service.
